Values of any nature held abroad by residents in Brazil. It can be annual (equivalent to US$1 million or more abroad) or quarterly (an amount equal to or greater than US$100 million abroad).

It is an electronic file, which can be installed simultaneously on several computers. This type of certificate offers more agility and is indicated for companies that want to have easier automation of tasks related to grades. Its validity is of 1 year.

Cadastro de Empresas Prestadoras de Outros Municípios

Nele será inscrito o prestador de serviços (pessoa jurídica) que for de outro Município, e prestar serviço para empresas estabelecidas em um município, com emissão de documento fiscal autorizado por outro Município.

Se o prestador de serviços não estiver cadastrado, deverá haver retenção do Imposto Sobre Serviços – ISS para o tomador.

Nem todas as cidades têm um processo de registro do CEPOM em vigor, pois nem todas as cidades exigem a retenção dos Provedores de Serviços localizados em outras jurisdições.

Registration of Service Providers from Other Jurisdictions

CEPOM is a registration mechanism created by cities to qualify and recognize the legal registration of service providers established in other cities (other jurisdictions). This is a way that cities found to make sure that service providers delivering services within their jurisdictions are compliant with the jurisdiction in which they are established. Service Providers that do not register with the local CEPOM are subject to local tax via withholding imposed as a buyer obligation. The CEPOM registration is voluntary but eliminated the double taxation for ISS (city tax on services). Not every city has a CEPOM registration process in place as not all cities require withholding from Service Providers based in other jurisdictions.

It is divided between Cide-fuels and Cide-shipments. A tax that ensures a number of resources for investment in infrastructure and projects related to the oil and gas industry. Cide-remittances, on the other hand, are intended to fund the Siscomex operation.

Centro Nacional de Automação Bancária

O CNAB, também conhecido como "Boleto", é um documento padrão para remessas criado pela FEBRABAN (Federação Brasileira de Bancos). É um documento com código de barras que permite o processamento eletrônico dos pagamentos. O processo suporta o banco eletrônico com padrões para envio de pagamentos, reconciliação e permite a transação de pagamento eletrônico real pelo beneficiário. Para evitar fraudes, os CNABs a partir de 2019 são pré-registrados no banco do pagador à medida que são emitidos.

National Center of Banking Automation

CNAB, also known as "Boleto" is a standard document for remittance created by the FEBRABAN (Brazilian Banks Federation). It is a barcoded document that allows payments to be processed electronically. The process supports electronic banking with standards for submitting payments, reconciliation and enables the actual electronic payment transaction by the payee. To avoid fraud, CNABs starting in 2019 are pre-registered with the payor's bank as they are issued.

Conselho Nacional de Política Fazendária - "é o colegiado formado pelos Secretários de Fazenda, Finanças ou Tributação dos Estados e do Distrito Federal, cujas reuniões são presididas pelo Ministro de Estado da Fazenda" (CONFAZ). Tem por objetivo dar apoio para a concessão ou revogação de isenções, incentivos e benefícios fiscais e financeiros do ICMS.

National Council of fiscal Policy - "it is the collegiate formed by the Secretaries of Finance, Finance or Taxation of the States and of the Federal District, whose meetings are chaired by the Minister of State for Finance" (CONFAZ). Its purpose is to support the granting or revocation of ICMS tax and financial exemptions, incentives, and benefits.

Contribuições sociais / Social Taxes

As contribuições sociais foram criadas para financiar programas e iniciativas do governo federal na area social. Essas contribuições foram criadas como temporárias porem se tornaram perpetuas com o decorrer dos tempos. Inclui-se nas contribuições sociais o PIS/PASEP e a COFINS. A CSLL tem impacto como imposto indireto nas prestações de serviço quando está sujeita a retenção na fonte.

Think of Social Taxes as a subset of indirect taxes with a specific destination to funding social initiatives. These are social contributions created by the federal government to finance social security and other social programs. These contributions were created as temporary measures but became permanent over time. They include PIS/PASEP and COFINS. The CSLL, a direct tax on net profit is levied together with PIS and COFINS in service transactions as withholding.

É o sujeito passivo de uma obrigação tributária. Toda pessoa – física ou jurídica – que paga tributo (sentido genérico) aos cofres públicos, quer seja da União, dos Estados, dos Municípios e/ou do Distrito Federal. O Código Tributário Nacional, em seu Art. 121, parágrafo único, I, conceitua como contribuinte o "sujeito passivo da obrigação principal ... quando tenha relação pessoal e direta com a situação que constitua o respectivo fato gerador".

It is the taxable person of a tax obligation. Every person – natural or legal – pays a tax (generic sense) to the public coffers, whether from the Union, States, Municipalities, and/or the Federal District. The National Tax Code, in its Article 121, sole paragraph, I, defines as a taxpayer the "taxpayer of the main obligation ... when he has a personal and direct relationship with the situation that constitutes the respective taxable event".

Documento de Arrecadação Estadual do eSocial - documento único por Estado em que é possível recolher diversos tipos de tributo. Os tributos e o FGTS relacionados à folha de pagamento do empregador doméstico são recolhidos em apenas uma guia. As seguintes responsabilidades serão recolhidas no DAE, gerado pelo Módulo Doméstico do eSocial:

Valores de responsabilidade do empregador: 8,0% de contribuição patronal previdenciária; 0,8% de seguro contra acidentes do trabalho (GILRAT); 8,0% de FGTS; 3,2% de indenização compensatória (Multa FGTS).

Valores retidos do salário do trabalhador: 8,0% a 11,0% de contribuição previdenciária; Imposto sobre a Renda Pessoa Física, se incidente.

eSocial State Collection Document - a single document per State in which it is possible to collect different types of taxes. Taxes and FGTS related to the domestic employer's payroll are collected in a single tab. The following responsibilities will be collected in the DAE, generated by the eSocial Domestic Module:

Employer responsibility amounts: 8.0% of employer social security contribution; 0.8% insurance against accidents at work (GILRAT); 8.0% FGTS; 3.2% of compensatory indemnity (FGTS fine).

Devolução de Mercadorias / Return of Goods

No caso da mercadoria ser devolvida com a mesma NF-e, o destinatário deve informar no verso os motivos que o levaram a devolver, datar e assinar. Assim, o transporte das mercadorias e a própria escrituração poderá ser feita através da mesma NF-e de entrada. No caso da NF-e ter sido emitida pelo destinatário, o mesmo ca encarregado de emitir a nota scal para a devolução.

In case the goods are returned with the same NF-e, the recipient must inform on the back (of the NF-e) the reasons that led him to return, date, and sign. Thus, the transport of goods and the bookkeeping itself can be done through the same entry NF-e. In case the NF-e has been issued by the recipient, he is in charge of issuing the invoice for the return.

Declaration on the Use of Resources in Foreign Currency Arising from Receipt of Exports

As vendas a consumidores no Brasil são sempre tributadas à taxa intra-estadual e os impostos são retidos inteiramente pelo estado de origem. Isso criou uma disputa entre estados não produtores que não estavam cobrando nenhum imposto sobre compras online e por telefone de seus residentes. O DIFAL é um procedimento que irá compensar os estados de destino com uma parcela do imposto aumentando gradativamente ao longo de um período de 4 anos quando os impostos serão devidos no destino.

Differential tax rates for the Tax on Circulation of Goods and Services - a resource to maintain competitiveness between interstate operations and those that suffered from the difference in tax rates.

Sales to consumers in Brazil are always taxed at the intrastate rate and taxes are withheld entirely by the state of origin. This created a dispute between non-producing states that were not levying any tax on online and telephone purchases from their residents. DIFAL is a procedure that will compensate destination states with a share of the tax gradually increasing over a period of 4 years when taxes will be due at the destination.

Ancillary obligation for taxpayers manufacturers, distributors, wholesalers or importers of packaging material in the cigarette, beverage, and other industries or as a raw material in the beverage and other industries, and manufacturers or importers of organic compounds used as an intermediate or final product in chemical, petrochemical, fuel and other industries.

Documento de Ordem de Crédito

DOC é um tipo de mecanismo de transferência direta de fundos (conta a conta) disponível no Brasil. Os DOCs passam pelo processo de compensação de cheques bancários e geralmente são concluídos em 24 horas. Uma vez que estão sujeitos a compensação, eles têm a flexibilidade de serem cancelados e suspensos (dentro de um intervalo de tempo). Os TEDs, por outro lado, não podem. Os DOCs têm limite máximo de R $ 4999. As transações DOC devem identificar o banco de destino, o número da conta e o número de identificação fiscal federal do usuário de destino. Eles podem ser iniciados a partir de aplicativos de dispositivos móveis, sites e pessoalmente no caixa do banco.

Credit Order Document

DOC is an EFT type of direct (account to account) fund transfer mechanism available in Brazil. DOCs go through the Banking Check Clearing process and are complete usually within 24 hours. Since they are subject to clearing they have the flexibility of being canceled and suspended (within a time slot). TEDs on the other hand cannot. DOCs have an upper limit of R$4999. DOC transactions must identity the destination bank, account number, and destination user's federal tax ID. They can be initiated from mobile devices apps, websites, and in-person at a bank teller.

Certificado digital e-CPF é um documento eletrônico de identidade emitido por Autoridade Certificadora credenciada pela Autoridade Certificadora Raiz da ICP-Brasil (AC-Raiz) e habilitada pela Autoridade Certificadora da Secretaria Especial da Receita Federal do Brasil (AC-RFB), que certifica a autenticidade dos emissores e destinatários dos documentos e dados que trafegam em uma rede de comunicação, bem como assegura sua privacidade e inviolabilidade.

The digital certificate for the Individual Federal Tax ID

Electronic identity document issued by a Certification Authority accredited by the Root Certification Authority of ICP-Brasil (AC-Raiz) and authorized by the Certification Authority of the Special Secretariat of the Federal Revenue of Brazil (AC- RFB), which certifies the authenticity of the issuers and recipients of documents and data that travel on a communication network, as well as ensuring their privacy and inviolability.

Validator and Digital Signature Application

The PVA is a downloadable application provided by the RFB (Federal Tax Authority) for validating and digitally signing the SPED files prior to filing. It is a solution that uses an unsigned SPED file as input and validates its structure (XML or txt file) and electronically signs it using a security certificate from the company responsible for the SPED and its accountant. Pauta or Statutory Retail Price is a price determined by a tax authority that must be used as a tax basis in transactions. When an item is taxed by its SRP, the actual transaction price is not relevant for tax purposes. The transactions are taxed based on the SRP. The SRP abbreviation is NOT commonly used in Brazil, it is all referred to as "Pauta".

TED é um tipo de mecanismo de transferência direta de fundos (conta para conta) disponível no Brasil. Os TEDs emitidos durante o horário comercial são concluídos em até 15 minutos. As transações TED podem ser iniciadas a partir de aplicativos de dispositivos móveis, sites e pessoalmente em um caixa. As transações TED devem identificar o banco de destino, o número da conta e o número de identificação fiscal federal do usuário de destino. Não há valor mínimo para transações TED. Por motivos de segurança, os limites superiores variam de acordo com o banco / conta e geralmente exigem uma autorização secundária.

Electronic Transfer Available

TED is an EFT type of direct (account to account) fund transfer mechanism available in Brazil. TEDs issued during normal business hours are completed in up to 15 minutes. TED transactions can be initiated from mobile devices apps, websites, and in-person at a bank teller. TED transactions must identity the destination bank, account number, and destination user's federal tax ID. There is no minimum amount for TED transactions. For security reasons, upper limits vary by bank/account and usually required secondary authorization.

Quando empresas pertencentes ao mesmo grupo empresarial, mas sediadas em localidades distintas, realizam uma transação, sujeitam-se às regras do Transfer Price (Preço de Transferência). Seu objetivo é regular as negociações de exportação e importação entre os países. Ele é utilizado em situações e empresas por meio de métodos de aplicação de valores estipulados pela Receita Federal. Tem por intenção garantir um padrão dos valores aplicados para essas transações. Com isso, evita-se que empresas burlem o sistema tributário por meio do favorecimento de preço.

Transfer Pricing

When companies belonging to the same business group, but headquartered in different locations, carry out a transaction, they are subject to Transfer Price rules. Its objective is to regulate export and import negotiations between countries. It is used in situations and companies through methods of application of values stipulated by the Internal Revenue Service. It is intended to ensure a standard for the amounts applied to these transactions. This prevents companies from circumventing the tax system by favoring prices.

No conceito clássico engloba, apenas, impostos, taxas de serviços públicos específicos e divisíveis e contribuição de melhoria (decorrente de obras públicas). O vocábulo tributo também é usado, no sentido genérico, para todo e qualquer valor, a qualquer título, pago ao Poder Público sem aquisição/compra/transferência de bens e/ou serviços diretos e específicos ou de concessão. Neste caso, o termo tributo alcança impostos, taxas, contribuições de melhoria, contribuições sociais e econômicas, encargos e tarifas tributários (com características fiscais) e emolumentos que contribuam para a formação da receita orçamentária da União, dos Estados, do Distrito Federal e dos Municípios.
